Welcome to Stateside Ants LLC (“we,” “us,” or “our”). These Terms & Conditions govern your use of our website, www.statesideants.com, and any purchase made through our store. By using our website or making a purchase, you agree to these terms.

1. General Use

By making a purchase, you confirm that you are at least 13 years old or have permission from a parent or legal guardian.

You agree to use this website only for lawful purposes and in accordance with these Terms & Conditions.

2. Live Ant Purchases

​

2.1 Live Arrival Guarantee (DOA Policy)

We guarantee that your ants will arrive alive. If a queen ant dies during shipping, we will provide a refund or replacement at no cost.


To qualify, you must provide clear photo or video evidence of the deceased queen within 8 hours of delivery.

2.2 Worker or Brood Mortality

Some loss of workers or brood can occur during transit and does not automatically qualify for replacement unless the queen is deceased.


However, we want our customers to receive healthy, thriving colonies. Even when the queen survives, if the ants arrive unhealthy, stressed, or with unusual losses, we will gladly review the situation. While not required, we typically offer replacements or accommodations when we believe the colony is below the standard we consider acceptable.

2.3 Queen Alive but Colony Severely Damaged

If the queen survives but the colony suffers major worker loss such that it is not reasonably salvageable, we will provide a free replacement colony, subject to availability.


If the colony is still viable, we are not obligated to replace it; however, we aim to be kind and fair. Customer satisfaction and animal welfare matter to us, so we often offer replacements or partial remedies when the colony’s condition is significantly affected by shipping.

3. Shipping Conditions

3.1 Delivery Location

We ship within the United States only.

​

3.2 Customer Presence

You are not required to be home at the time of delivery.


However, we recommend retrieving shipments promptly to avoid exposure to extreme temperatures or stress to the ants, and we are not obligated to replace or refund ants that seem to have died due to not being brought in promptly.

​

3.3 Carrier Delays & Responsibility

Once an order is shipped, USPS, UPS, or other carriers assume responsibility for timely delivery. We are not liable for carrier delays, weather issues, or routing errors.


Even so, we will always do our best to assist, including helping with claims or offering accommodations whenever possible.

4. Order Cancellations and Refunds

4.1 Before Shipment

Orders may be canceled before shipment for a full refund.

​

4.2 After Shipment

Once shipped, orders containing live ants cannot be canceled or refunded unless the queen arrives deceased or the colony is damaged due to a shipping issue.

​

4.3 Incorrect Address

Customers are responsible for providing an accurate and complete shipping address.


We are not liable for losses caused by incorrect or incomplete addresses.

5. Care Responsibility

After arrival, the customer assumes full responsibility for caring for the ants. Stateside Ants LLC is not liable for colony deaths or issues resulting from:

  • Improper care or setup

  • Incorrect temperature or humidity

  • Neglect or mismanagement

  • Failure to follow care recommendations

 

All care advice we provide is general guidance only.

6. Safety and Stings

Some ant species may bite or sting. By purchasing ants from Stateside Ants LLC, you acknowledge:

  • Ants may sting or cause allergic reactions

  • You assume all responsibility for handling them safely

  • You must research species behavior and safety before purchasing

 

We provide general species information when possible, but customers are ultimately responsible for understanding the risks associated with the species they choose.


Stateside Ants LLC is not liable for injuries, stings, allergic reactions, or harm resulting from handling ants.

7. Intellectual Property

All content on this website—including text, product descriptions, and care information—is the property of Stateside Ants LLC, unless otherwise noted.

 

Some photos may be provided by other ant keepers with permission. These images remain the property of their respective owners and may not be reproduced without their permission.

​

8. Limitation of Liability

Stateside Ants LLC is not liable for:

  • Carrier delays or delivery issues

  • Deaths or harm resulting from customer mishandling

  • Consequential or incidental damages

  • Losses caused by improper care

  • Stings, allergic reactions, or injuries caused by ants

 

Our total liability for any claim will not exceed the amount paid for the order.

9. Changes to These Terms

We may update these Terms & Conditions at any time.
Updates will be posted with a new “Last Updated” date.
Continued use of the website constitutes acceptance of the updated terms.
